Privacy Policy – AffiliGenius Ventures PVT LTD
Welcome to AffiliGenius Ventures PVT LTD (“We” or “Us”). By using the service provided through the Website and the App (“Platform”), you agree to the legal terms and conditions outlined in this Agreement.
Membership: Membership is available through a registration process where you provide requested information to AffiliGenius Ventures PVT LTD. Members are prohibited from running paid ads on platforms like Google or Facebook directing to AffiliGenius Ventures PVT LTD, and non-compliance results in immediate account termination.
Our Service: Our Service enables Members to earn a profit on tracked purchases made through customized links shared on personal networks. Qualifying Transactions generate a commission from Retailers, and Members receive a share as “Profit.” If Retailers fail to track a transaction, resulting in no commission, no Profit is due to the Member.
Becoming a Member: To use the Platform, you must be 18 years or older. By accepting these Terms and Conditions, you represent that you meet this age requirement. Accurate registration information is required. Profit payments via Cheque carry an additional Rs 30 fee.
Consent for the generation, collection, and sharing of ‘Sensitive Personal Data or Information’ is required in accordance with the Information Technology Act, 2000. Users provide consent during registration, allowing data sharing with retailer partners for risk analysis and statutory requirements.
Ensure your Profit Receipt Method details are accurate, and note that payment methods may have maximum or minimum payment rules. It’s crucial to keep your email and mobile number updated for receiving important communications. Changes in contact details should be promptly updated in your Account.
Profit and Referral Fees: Upon the successful completion of a Qualifying Transaction by a Member, and upon receipt of the resulting Profit, we transfer the Profit to the Member through their chosen Profit Receipt Method. It’s important to note that certain circumstances may lead to a transaction with a Retailer not being considered a Qualifying Transaction, or Profit may not result from it. Members acknowledge that transactions are with individual Retailers, and our help pages provide additional details on such scenarios. Retailers may adjust commissions, affecting the advertised rate, and we are not liable for differences between expected and actual Profit.
When a paying Qualifying Transaction is traced to your Account, we credit it as ‘pending payment.’ Upon Retailer confirmation, the payment is marked as ‘validated,’ a process taking 90 days or more. If goods are returned, the sale is reversed, or amended, Profit payment is not made. Members must inform AffiliGenius Ventures PVT LTD about any returns or exchanges leading to undue Profit.
The qualification of a transaction as a Qualifying for Profit Transaction rests at the discretion of the Retailer or us, and Members understand and agree to this. We are not responsible if a Retailer fails to report a sale or disqualifies a transaction. If, due to technical errors, a sale can’t be traced back to the Member, and it’s not considered a Qualifying Transaction or Qualifying Referral, we are not liable. We reserve the right to reclaim or adjust balances due to errors, misuse, or fraud, recovering unduly paid Profit through legal proceedings.
Your Account: Members can withdraw validated Profit when their Account reaches at least INR 10. If a Member closes their Account with less than INR 10, the entire amount is forfeited. For validated Profit above Rs 250, Members can request payment through Profit Receipt Methods. Cheque payments incur an additional Rs 30 fee. AffiliGenius Ventures PVT LTD has the discretion to forfeit validated balances for reasons mentioned in this Agreement.
Intellectual Property: All copyright, trademarks, and intellectual property rights related to the Platform are owned by us. Members grant us a non-exclusive license to use, reproduce, and distribute uploaded material through our Service. Other Members have the right to view the material under the granted license.
Privacy Policy: Our Privacy Policy is an integral part of this Agreement, and by entering into this Agreement, you consent to the handling of your personal data as outlined in that policy.
Our Role: We are not a party to transactions with Retailers and bear no legal obligations as sellers. Members release us from liability related to transactions with Retailers, emphasizing the need for caution in online transactions.
Misuse: We reserve the right to suspend or terminate a Member’s access to our service if they breach any provisions of this Agreement. Members must not misuse our service to gain Profit through deceptive practices, and we may forfeit payments in case of misuse.
Members are responsible for posted material, ensuring it adheres to specified guidelines. We reserve the right to investigate and take appropriate action against violations, including reporting unlawful activities to relevant authorities. Fraudulent use may lead to Account closure and blacklisting of email and IP addresses. Members are encouraged to report any infringing content on our Platform.
Contact from Third Parties: If a third party contacts us regarding material or transactions linked to you or your Account, you agree to:
- Provide all reasonable information and assistance required for responding to the contact.
- Respond promptly and accurately if we relay the message to you.
Additional Services: New or additional services may be offered on the Platform by us or our partners. Your usage of such services may be subject to additional terms and conditions, which you must adhere to. Non-compliance with material provisions of these terms will constitute a breach of this Agreement.
Operation of Our Service: We retain the right to withdraw, modify, or suspend aspects or the entirety of the Service for legal, security, technical, or commercial reasons. Advance notice of 30 days will be given, except for instances requiring earlier action due to security or technical difficulties. Periods of planned unavailability will be minimized, and users will be informed.
For security, password changes may be required, and we will never solicit passwords via email, telephone, or other means. Users are responsible for password confidentiality.
Disclaimer and Limitation of Liability:
Disclaimer: The Platform’s content is provided “as-is,” with all faults, and all express or implied warranties, including merchantability and fitness for a particular purpose, are disclaimed. We and affiliated parties are not liable for indirect, special, or incidental damages. The limitation of damages is fundamental to this Agreement, and no advice or information outside this Agreement creates additional warranties.
Liability:
- The Service is provided with reasonable care, meeting specifications, but we don’t guarantee meeting your requirements.
- Liability is limited to direct loss or damage, not exceeding Rs 500, excluding certain types of loss.
- We are not liable for various losses, including indirect, special, or consequential damages.
Third-Party Content: We are not responsible for third-party content on the Platform or accessible through hyperlinks, disclaiming liability for errors, defamation, obscenity, or other forms of content.
Communications: Users agree to receive communications via SMS, emails, mobile app, browser notifications, or other messages from AffiliGenius Ventures PVT LTD regarding Services provided through the Website.
Indemnity: Users indemnify us against liabilities, claims, and expenses arising from a breach of this Agreement or any transaction with a Retailer.
Assignment: We reserve the right to assign or subcontract rights and obligations under this Agreement. Users may not assign or dispose of this Agreement without written consent.
Entire Agreement: This Agreement constitutes the entire agreement between us and supersedes earlier agreements, except for fraud.
Changes to this Agreement: We may change this Agreement, with the new version taking effect no less than three days after posting for material changes. Users not agreeing to the new version can cease using the service.
General: Invalidity of a term doesn’t affect the rest of the Agreement. We and users are independent contractors, and our failure to act on a breach does not waive the right to act on subsequent breaches.
Governing Law: This Agreement is governed by Indian laws, with disputes subject to the non-exclusive jurisdiction of Indian courts.
Keeping this Agreement: Individual agreements are not separately filed. Access it at AffiliGenius Ventures PVT LTD and create a durable copy by printing or saving.
